DoWell & DoingWell Terms & Privacy Policy

Conditions for use of the DoWell App

DoingWell and the DoWell apps is designed to never collect or store any sensitive information. DoingWell and the DoWell apps messages and calls cannot be accessed by us or other third parties because they are  on your mobile, protected with OpenId, private, and secure. Our Terms of Service and Privacy Policy are available below.

Terms of Service

DoingWell and the DoWell apps Messenger BV. (“DoingWell and the DoWell apps”) utilizes state-of-the-art security  to provide private messaging, Internet calling, and other services to users worldwide. You agree to our Terms of Service (“Terms”) by installing or using our apps, services, or website (together, “Services”).

About our services

Minimum Age. You must be at least 13 years old to use our Services. The minimum age to use our Services without parental approval may be higher in your home country.

Account Registration. To create an account you must register for our Services using your phone number and email address. We do need to create a secure key on our servers for your registration You agree to receive text messages and phone calls (from us or our third-party providers) with verification codes to register for our Services.

Privacy of user data. DoingWell and the DoWell apps does not sell, rent or monetize your personal data or content in any way – ever. However you can order with companies that offer products or services. You have an agreement with those companies when you do that. DoWell is not responsible in any way between you and any company or organization. When you provide your information (for example your name and address) you agree that this information is used for hat purpose. Your data is under your controle and you have all the rights to protect your privacy. If you have request related to GDPR please send us an email at : infor@doingwell.eu. You can change or remove your data at any time from the APP, but this will block the delivery of your orders or services.

We have done all for you to login securely on Dowell. Using DoingWell and the DoWell apps is at your own risk.

Our Terms and Policies. You must use our Services according to our Terms and posted policies. If we disable your account for a violation of our Terms, you will not create another account without our permission.

Legal and Acceptable Use. You agree to use our Services only for legal, authorized, and acceptable purposes. You will not use (or assist others in using) our Services in ways that: (a) violate or infringe the rights of DoingWell and the DoWell apps, our users, or others, including privacy, publicity, intellectual property, or other proprietary rights; (b) involve sending illegal or impermissible communications such as bulk messaging, auto-messaging, and auto-dialing.

Harm to DoingWell and the DoWell apps. You must not (or assist others to) access, use, modify, distribute, transfer, or exploit our Services in unauthorized manners, or in ways that harm DoingWell and the DoWell apps, our Services, or systems. For example you must not (a) gain or try to gain unauthorized access to our Services or systems; (b) disrupt the integrity or performance of our Services; (c) create accounts for our Services through unauthorized or automated means; (d) collect information about our users in any unauthorized manner; or (e) sell, rent, or charge for our Services.

Keeping Your Account Secure. DoingWell and the DoWell apps embraces privacy by design and does not have the ability to access your messages. You are responsible for keeping your device and your DoingWell and the DoWell apps account safe and secure. If you lose your phone, follow the steps on our Support site to re-register for our Services. When you register with a new device, your old device will stop receiving all messages and calls.

No Access to Emergency Services. Our Services do not provide access to emergency service providers like the police, fire department, hospitals, or other public safety organizations. Make sure you can contact emergency service providers through a mobile, fixed-line telephone, or other service.

Third-party services. Our Services may allow you to access, use, or interact with third-party websites, apps, content, and other products and services. When you use third-party services, their terms and privacy policies govern your use of those services.

Your Rights and License with DoingWell and the DoWell apps

Your Rights. You own the information you submit through our Services. You must have the rights to the phone number you use to sign up for your DoingWell and the DoWell apps account.

DoingWell and the DoWell apps’s Rights. We own all copyrights, trademarks, domains, logos, trade dress, trade secrets, patents, and other intellectual property rights associated with our Services. You may not use our copyrights, trademarks, domains, logos, trade dress, patents, and other intellectual property rights unless you have our written permission. To report copyright, trademark, or other intellectual property infringement, please contact abuse@DoingWell and the DoWell apps.org.

DoingWell and the DoWell apps’s License to You. DoingWell and the DoWell apps grants you a limited, revocable, non-exclusive, and non-transferable license to use our Services in accordance with these Terms.

Disclaimers and Limitations

Disclaimers. YOU USE OUR SERVICES AT YOUR OWN RISK AND SUBJECT TO THE FOLLOWING DISCLAIMERS. WE PROVIDE OUR SERVICES ON AN “AS IS” BASIS WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND FREEDOM FROM COMPUTER VIRUS OR OTHER HARMFUL CODE. DOINGWELL AND THE DOWELL APPS DOES NOT WARRANT THAT ANY INFORMATION PROVIDED BY US IS ACCURATE, COMPLETE, OR USEFUL, THAT OUR SERVICES WILL BE OPERATIONAL, ERROR-FREE, SECURE, OR SAFE, OR THAT OUR SERVICES WILL FUNCTION WITHOUT DISRUPTIONS, DELAYS, OR IMPERFECTIONS. WE DO NOT CONTROL, AND ARE NOT RESPONSIBLE FOR, CONTROLLING HOW OR WHEN OUR USERS USE OUR SERVICES. Limitation of liability. THE DOINGWELL AND THE DOWELL APPS PARTIES WILL NOT BE LIABLE TO YOU FOR ANY LOST PROFITS OR CONSEQUENTIAL, SPECIAL, PUNITIVE, INDIRECT, OR INCIDENTAL DAMAGES RELATING TO, ARISING OUT OF, OR IN ANY WAY IN CONNECTION WITH OUR TERMS, US, OR OUR SERVICES, EVEN IF THE DOINGWELL AND THE DOWELL APPS PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY RELATING TO, ARISING OUT OF, OR IN ANY WAY IN CONNECTION WITH OUR TERMS, US, OR OUR SERVICES WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). Availability of Our Services. Our Services may be interrupted, including for maintenance, upgrades, or network or equipment failures. We may discontinue some or all of our Services, including certain features and the support for certain devices and platforms, at any time.

Resolving Disputes and Ending Terms

Resolving disputes. You agree to resolve any Claim you have with us relating to or arising out of our Terms, us, or our Services exclusively in the Netherlands, in the European Union You also agree to submit to the personal jurisdiction of such courts for the purpose of litigating all such disputes. The laws of the State of Netherlands, in the European Union govern our Terms, as well as any disputes, whether in court or arbitration, which might arise between DoingWell and the DoWell apps and you, without regard to conflict of law provisions.

Ending these Terms. You may end these Terms with DoingWell and the DoWell apps at any time by deleting DoingWell and the DoWell apps Messenger from your device and discontinuing use of our Services. We may modify, suspend, or terminate your access to or use of our Services anytime for any reason, such as if you violate the letter or spirit of our Terms or create harm, risk, or possible legal exposure for DoingWell and the DoWell apps. The following provisions will survive termination of your relationship with DoingWell and the DoWell apps: “Licenses,” “Disclaimers,” “Limitation of Liability,” “Resolving dispute,” “Availability” and “Ending these Terms,” and “General”.

General

DoingWell and the DoWell apps may update the Terms from time to time. When we update our Terms, we will update the “Last Modified” date associated with the updated Terms. Your continued use of our Services confirms your acceptance of our updated Terms and supersedes any prior Terms. You will comply with all applicable export control and trade sanctions laws. Our Terms cover the entire agreement between you and DoingWell and the DoWell apps regarding our Services. If you do not agree with our Terms, you should stop using our Services.

If we fail to enforce any of our Terms, that does not mean we waive the right to enforce them. If any provision of the Terms is deemed unlawful, void, or unenforceable, that provision shall be deemed severable from our Terms and shall not affect the enforceability of the remaining provisions. Our Services are not intended for distribution to or use in any country where such distribution or use would violate local law or would subject us to any regulations in another country. User Support. If you contact DoingWell and the DoWell apps User Support, any personal data you may share with us is kept only for the purposes of researching the issue and contacting you about your case.

Managing your information. You can manage your personal information in DoingWell and the DoWell apps’s application Settings. For example, you can update your profile information or choose to enable additional privacy features like a Registration Lock PIN.

Information we may share

Third Parties. We work with third parties to provide some of our Services. For example, our Third-Party Providers send a verification code to your phone number when you register for our Services. These providers are bound by their Privacy Policies to safeguard that information. If you use other Third-Party Services like Paypal, VISA, YouTube, etc. in connection with our Services, their Terms and Privacy Policies govern your use of those services.

Other instances where DoingWell and the DoWell apps may need to share your data

  • To meet any applicable law, regulation, legal process or enforceable governmental request.
  • To enforce applicable Terms, including investigation of potential violations.
  • To detect, prevent, or otherwise address fraud, security, or technical issues.
  • To protect against harm to the rights, property, or safety of DoingWell and the DoWell apps, our users, or the public as required or permitted by law.

Updates

We will update this privacy policy as needed so that it is current, accurate, and as clear as possible. Your continued use of our Services confirms your acceptance of our updated Privacy Policy.

Messages. By using our service you agree to accept our methods to deliver this service. DoingWell and the DoWell apps does not decrypt or access the content of your messages or calls. DoingWell and the DoWell apps queues end-to-end encrypted messages on its servers for delivery to devices that are temporarily offline (e.g. a phone whose battery has died). Your message history is stored on your own devices.

Additional technical information is stored on our servers, including randomly generated authentication tokens, keys, push tokens, and other material that is necessary to establish calls and transmit messages. DoingWell and the DoWell apps limits this additional technical information to the minimum required to operate the Services.

Contacts. DoingWell and the DoWell apps can optionally discover which contacts in your address book are DoingWell and the DoWell apps users, using a service designed to protect the privacy of your contacts. Information from the contacts on your device may be cryptographically hashed and transmitted to the server Information you provide

Account Information. You register a phone number when you create a DoingWell and the DoWell apps account. Phone numbers are used to provide our Services to you and other DoingWell and the DoWell apps users. You may optionally add other information to your account, such as a profile name and profile picture

DoWell is not responsible to any actions you perform on our App or software systems. You will be ,and remain, responsible for all your actions, now or in the future. DoWell is a bv based in the Netherlands (kvk : 30207947). You agree tot the registration of your contact details fort he purpose of using our App and our software and systems, and for  sending and receiving products and/ or services. If you do not agree, then you will remove your contact details from the DoWell App. You agree that fort he purpose of purpose of sending and receiving products and/ or services, your contact details may be available to companies from whom you order products and/ or services. This data will not be used for other purposes, nor shall you use any others ’s contact details unless they have given you explicit consent.  You are responsible for keeping your contact details, your data and information up to date. If you no longer wish to use our App or software, then you are responsible for removing all. No responsibility shall be transferred to DoWell

  • Better Communication With Businesses. Many businesses rely on DoWell/ BinSoft to communicate with their customers and clients. We work with businesses that use BinSoft or third parties to help store and better manage their communications with you on DoWell/ BinSoft.
  • Making It Easier To Connect. As part of the BinSoft Companies, DoWell/ BinSoft partners with BinSoft to offer experiences and integrations across BinSoft’s family of apps and products.

Information We Collect

DoWell/ BinSoft must receive or collect some information to operate, provide, improve, understand, customize, support, and market our Services, including when you install, access, or use our Services.

The types of information we receive and collect depend on how you use our Services. We require certain information to deliver our Services and without this we will not be able to provide our Services to you. For example, you must provide your mobile phone number to create an account to use our Services.

Our Services have optional features which, if used by you, require us to collect additional information to provide such features. You will be notified of such collection, as appropriate. If you choose not to provide the information needed to use a feature, you will be unable to use the feature. For example, you cannot share your location with your contacts if you do not permit us to collect your location data from your device. Permissions can be managed through your Settings menu on both Android and iOS devices.

Information You Provide

  • Your Account Information. You must provide your mobile phone number and basic information (including a profile name of your choice) to create a DoWell/ BinSoft account. If you don’t provide us with this information, you will not be able to create an account to use our Services. You can add other information to your account, such as a profile picture and “about” information.
  • Your Messages. We do not retain your messages in the ordinary course of providing our Services to you. Instead, your messages are stored on your device and not typically stored on our servers. Once your messages are delivered, they are deleted from our servers. The following scenarios describe circumstances where we may store your messages in the course of delivering them:
    • Undelivered Messages. If a message cannot be delivered immediately (for example, if the recipient is offline), we keep it in encrypted form on our servers for up to 30 days as we try to deliver it. If a message is still undelivered after 30 days, we delete it.
    • Media Forwarding. When a user forwards media within a message, we store that media temporarily in encrypted form on our servers to aid in more efficient delivery of additional forwards.We offer end-to-end scurity for our Services. End-to-end scurity means that your messages are encrypted to protect against us and third parties from reading them.
  • Your Connections. You can use the contact upload feature and provide us, if permitted by applicable laws, with the phone numbers in your address book on a regular basis, including those of users of our Services and your other contacts. If any of your contacts aren’t yet using our Services, we’ll manage this information for you in a way that ensures those contacts cannot be identified by us. Learn more about our contact upload feature here. You can create, join, or get added to groups and broadcast lists, and such groups and lists get associated with your account information. You give your groups a name. You can provide a group profile picture or description.
  • Status Information. You may provide us your status if you choose to include one on your account. Learn how to use status on AndroidiPhone, or KaiOS.
  • Transactions And Payments Data. If you use our payments services, or use our Services meant for purchases or other financial transactions, we process additional information about you, including payment account and transaction information. Payment account and transaction information includes information needed to complete the transaction (for example, information about your payment method, shipping details and transaction amount). If you use our payments services available in your country or territory, our privacy practices are described in the applicable payments privacy policy.
  • Customer Support And Other Communications. When you contact us for customer support or otherwise communicate with us, you may provide us with information related to your use of our Services, including copies of your messages, any other information you deem helpful, and how to contact you (e.g., an email address). For example, you may send us an email with information relating to app performance or other issues.

 

Automatically Collected Information

  • Usage And Log Information. We collect information about your activity on our Services, like service-related, diagnostic, and performance information. This includes information about your activity (including how you use our Services, your Services settings, how you interact with others using our Services (including when you interact with a business), and the time, frequency, and duration of your activities and interactions), log files, and diagnostic, crash, website, and performance logs and reports. This also includes information about when you registered to use our Services; the features you use like our messaging, calling, Status, groups (including group name, group picture, group description), payments or business features; profile photo, “about” information; whether you are online, when you last used our Services (your “last seen”); and when you last updated your “about” information.
  • Device And Connection Information. We collect device and connection-specific information when you install, access, or use our Services. This includes information such as hardware model, operating system information, battery level, signal strength, app version, browser information, mobile network, connection information (including phone number, mobile operator or ISP), language and time zone, IP address, device operations information, and identifiers (including identifiers unique to BinSoft Company Productsassociated with the same device or account).
  • Location Information. We collect and use precise location information from your device with your permission when you choose to use location-related features, like when you decide to share your location with your contacts or view locations nearby or locations others have shared with you. There are certain settings relating to location-related information which you can find in your device settings or the in-app settings, such as location sharing. Even if you do not use our location-related features, we use IP addresses and other information like phone number area codes to estimate your general location (e.g., city and country). We also use your location information for diagnostics and troubleshooting purposes.
  • Cookies. We use cookies to operate and provide our Services, including to provide our Services that are web-based, improve your experiences, understand how our Services are being used, and customize them. For example, we use cookies to provide our Services for web and desktop and other web-based services. We may also use cookies to understand which of our Help Center articles are most popular and to show you relevant content related to our Services. Third-Party Information

  • Information Others Provide About You. We receive information about you from other users. For example, when other users you know use our Services, they may provide your phone number, name, and other information (like information from their mobile address book) just as you may provide theirs. They may also send you messages, send messages to groups to which you belong, or call you. We require each of these users to have lawful rights to collect, use, and share your information before providing any information to us.
    You should keep in mind that in general any user can capture screenshots of your chats or messages or make recordings of your calls with them and send them to DoWell/ BinSoft or anyone else, or post them on another platform.
  • User Reports. Just as you can report other users, other users or third parties may also choose to report to us your interactions and your messages with them or others on our Services; for example, to report possible violations of our Terms or policies. When a report is made, we collect information on both the reporting user and reported user. To find out more about what happens when a user report is made, please contact us.
  • Businesses On DoWell/ BinSoft. Businesses you interact with using our Services may provide us with information about their interactions with you. We require each of these businesses to act in accordance with applicable law when providing any information to us.
    When you message with a business on DoWell/ BinSoft, keep in mind that the content you share may be visible to several people in that business. In addition, some businesses might be working with third-party service providers (which may include BinSoft) to help manage their communications with their customers. For example, a business may give such third-party service provider access to its communications to send, store, read, manage, or otherwise process them for the business. To understand how a business processes your information, including how it might share your information with third parties or BinSoft, you should review that business’ privacy policy or contact the business directly.
  • Third-Party Service Providers. We work with third-party service providers and other BinSoft Companiesto help us operate, provide, improve, understand, customize, support, and market our Services. For example, we work with them to distribute our apps; provide our technical and physical infrastructure, delivery, and other systems; provide engineering support, cybersecurity support, and operational support; supply location, map, and places information; process payments; help us understand how people use our Services; market our Services; help you connect with businesses using our Services; conduct surveys and research for us; ensure safety, security, and integrity; and help with customer service. These companies may provide us with information about you in certain circumstances; for example, app stores may provide us with reports to help us diagnose and fix service issues.
    The “How We Work With Other BinSoft Companies” section below provides more information about how DoWell/ BinSoft collects and shares information with the other BinSoft Companies.
  • Third-Party Services. We allow you to use our Services in connection with third-party services and BinSoft Company Products. If you use our Services with such third-party services or BinSoft Company Products, we may receive information about you from them; for example, if you use the DoWell/ BinSoft share button on a news service to share a news article with your DoWell/ BinSoft contacts, groups, or broadcast lists on our Services, or if you choose to access our Services through a mobile carrier’s or device provider’s promotion of our Services. Please note that when you use third-party services or BinSoft Company Products, their own terms and privacy policies will govern your use of those services and products.

How We Use Information

We use information we have (subject to choices you make and applicable law) to operate, provide, improve, understand, customize, support, and market our Services. Here’s how:

  • Our Services. We use information we have to operate and provide our Services, including providing customer support; completing purchases or transactions; improving, fixing, and customizing our Services; and connecting our Services with BinSoft Company Productsthat you may use. We also use information we have to understand how people use our Services; evaluate and improve our Services; research, develop, and test new services and features; and conduct troubleshooting activities. We also use your information to respond to you when you contact us.
  • Safety, Security, And Integrity. Safety, security, and integrity are an integral part of our Services. We use information we have to verify accounts and activity; combat harmful conduct; protect users against bad experiences and spam; and promote safety, security, and integrity on and off our Services, such as by investigating suspicious activity or violations of our Terms and policies, and to ensure our Services are being used legally.   • Communications About Our Services And The BinSoft Companies. We use information we have to communicate with you about our Services and let you know about our terms, policies, and other important updates. We may provide you marketing for our Services and those of the BinSoft Companies.
  • No Third-Party Banner Ads. We still do not allow third-party banner ads on our Services. We have no intention to introduce them, but if we ever do, we will update this Privacy Policy.
  • Business Interactions. We enable you and third parties, like businesses, to communicate and interact with each other using our Services, such as A list of productsfor businesses on DoWell/ BinSoft through which you can browse products and services and place orders. Businesses may send you transaction, appointment, and shipping notifications; product and service updates; and marketing. For example, you may receive flight status information for upcoming travel, a receipt for something you purchased, or a notification when a delivery will be made. Messages you receive from a business could include an offer for something that might interest you. We do not want you to have a spammy experience; as with all of your messages, you can manage these communications, and we will honor the choices you make.

Information You And We Share

You share your information as you use and communicate through our Services, and we share your information to help us operate, provide, improve, understand, customize, support, and market our Services.

  • Send Your Information To Those With Whom You Choose To Communicate. You share your information (including messages) as you use and communicate through our Services.
  • Information Associated With Your Account. Your phone number, profile name and photo, “about” information, last seen information, and message receipts are available to anyone who uses our Services, although you can configure your Services settings to manage certain information available to other users, including businesses, with whom you communicate.
  • Your Contacts And Others. Users, including businesses, with whom you communicate can store or reshare your information (including your phone number or messages) with others on and off our Services. You can use your Services settings and the “block” feature in our Services to manage who you communicate with on our Services and certain information you share.
  • Businesses On DoWell/ BinSoft. We offer specific services to businesses such as providing them with metrics regarding their use of our Services.
  • Third-Party Service Providers. We work with third-party service providers and other BinSoft Companiesto help us operate, provide, improve, understand, customize, support, and market our Services. We work with these companies to support our Services, such as to provide technical infrastructure, delivery and other systems; market our Services; conduct surveys and research for us; protect the safety, security, and integrity of users and others; and assist with customer service. When we share information with third-party service providers and other BinSoft Companies in this capacity, we require them to use your information on our behalf in accordance with our instructions and terms.
  • Third-Party Services. When you or others use third-party services or other BinSoft Company Productsthat are integrated with our Services, those third-party services may receive information about what you or others share with them. For example, if you use a data backup service integrated with our Services (like iCloud or Google Drive), they will receive information you share with them, such as your DoWell/ BinSoft messages. If you interact with a third-party service or another BinSoft Company Product linked through our Services, such as when you use the in-app player to play content from a third-party platform, information about you, like your IP address and the fact that you are a DoWell/ BinSoft user, may be provided to such third party or BinSoft Company Product. Please note that when you use third-party services or other BinSoft Company Products, their own terms and privacy policies will govern your use of those services and products.

How We Work With Other BinSoft Companies

As part of the BinSoft Companies, DoWell/ BinSoft receives information from, and shares information (see here) with, the other BinSoft Companies. We may use the information we receive from them, and they may use the information we share with them, to help operate, provide, improve, understand, customize, support, and market our Services and their offerings, including the BinSoft Company Products. This includes:

  • helping improve infrastructure and delivery systems;
  • understanding how our Services or theirs are used;
  • promoting safety, security, and integrity across the BinSoft Company Products, e.g., securing systems and fighting spam, threats, abuse, or infringement activities;
  • improving their services and your experiences using them, such as making suggestions for you (for example, of friends or group connections, or of interesting content), personalizing features and content, helping you complete purchases and transactions, and showing relevant offers and ads across the BinSoft Company Products; and
  • providing integrations which enable you to connect your DoWell/ BinSoft experiences with other BinSoft Company Products. For example, allowing you to connect your Facebook Pay account to pay for things on DoWell/ BinSoft or enabling you to chat with your friends on other BinSoft Company Products, such as Portal, by connecting your DoWell/ BinSoft account.

Managing And Retaining Your Information

You can access or port your information using our in-app Request Account Info feature (available under Settings > Account). For iPhone users, you can learn how to accessmanage, and delete your information through our information.  For Android users, you can learn how to manage, and delete your information through our Android Help Center articles.

We store information for as long as necessary for the purposes identified in this Privacy Policy, including to provide our Services or for other legitimate purposes, such as complying with legal obligations, enforcing and preventing violations of our Terms, or protecting or defending our rights, property, and users. The storage periods are determined on a case-by-case basis that depends on factors like the nature of the information, why it is collected and processed, relevant legal or operational retention needs, and legal obligations.

If you would like to further manage, change, limit, or delete your information, you can do that through the following tools:

  • Services Settings. You can change your Services settings to manage certain information available to other users. You can manage your contacts, groups, and broadcast lists, or use our “block” feature to manage the users with whom you communicate.
  • Changing Your Mobile Phone Number, Profile Name And Picture, And “About” Information. If you change your mobile phone number, you must update it using our in-app change number feature and transfer your account to your new mobile phone number. You can also change your profile name, profile picture, and “about” information at any time.
  • Deleting Your DoWell/ BinSoft Account. You can delete your DoWell/ BinSoft account at any time (including if you want to revoke your consent to our use of your information pursuant to applicable law) using our in-app delete my account feature. When you delete your DoWell/ BinSoft account, your undelivered messages are deleted from our servers as well as any of your other information we no longer need to operate and provide our Services. Deleting your account will, for example, delete your account info and profile photo, delete you from all DoWell/ BinSoft groups, and delete your DoWell/ BinSoft message history. Be mindful that if you only delete DoWell/ BinSoft from your device without using our in-app delete my account feature, your information will be stored with us for a longer period. Please remember that when you delete your account, it does not affect your information related to the groups you created or the information other users have relating to you, such as their copy of the messages you sent them.

We access, preserve, and share your information described in the “Information We Collect” section of this Privacy Policy above if we have a good-faith belief that it is necessary to: (a) respond pursuant to applicable law or regulations, legal process, or government requests; (b) enforce our Terms and any other applicable terms and policies, including for investigations of potential violations; (c) detect, investigate, prevent, or address fraud and other illegal activity or security, and technical issues; or (d) protect the rights, property, and safety of our users, DoWell/ BinSoft, the other BinSoft Companies, or others, including to prevent death or imminent bodily harm.

Our Global Operations

DoWell/ BinSoft shares information globally, both internally within the BinSoft Companies and externally with our partners and service providers, and with those with whom you communicate around the world, in accordance with this Privacy Policy. Your information may, for example, be transferred or transmitted to, or stored and processed in, the United States; countries or territories where the BinSoft Companies’ affiliates and partners, or our service providers are located; or any other country or territory globally where our Services are provided outside of where you live for the purposes as described in this Privacy Policy. DoWell/ BinSoft uses BinSoft’s global infrastructure and data centers, including in the United States. These transfers are necessary to provide the global Services set forth in our Terms. Please keep in mind that the countries or territories to which your information is transferred may have different privacy laws and protections than what you have in your home country or territory.

Gegevens die we verzamelen

Welke soorten gegevens we ontvangen en verzamelen, is afhankelijk van hoe u onze Diensten gebruikt. In overeenstemming met onze Voorwaarden hebben we sommige van Uw accountgegevens nodig om onze Diensten te leveren en zonder die gegevens kunnen we u onze Diensten niet verlenen. Zo moet u uw mobiele telefoonnummer opgeven om een account te maken voor gebruik van onze Diensten.

Onze Diensten hebben optionele functies die, indien u die gebruikt, vereisen dat wij aanvullende informatie verzamelen om dergelijke functies te kunnen aanbieden. U wordt ervan op de hoogte gesteld dat wij die informatie verzamelen, wanneer dat van toepassing is. Als u ervoor kiest om de informatie die nodig is om een functie te gebruiken niet te verstrekken, dan kunt u de functie niet gebruiken. U kunt uw Nauwkeurige locatiegegevens bijvoorbeeld niet delen met uw contacten als u het delen van locatie niet toestaat op uw apparaat. Toestemmingen kunnen via uw apparaatinstellingen worden beheerd op Android- en iOS-apparaten.
Gegevens die u verstrekt
• Uw accountgegevens. U dient uw mobiele telefoonnummer en gewenste profielnaam te verstrekken om een DoWell-account te maken. Als u deze gegevens niet aan ons verstrekt, kunt u geen account maken om onze Diensten te gebruiken. U kunt ook andere optionele gegevens toevoegen aan uw account, zoals een profielfoto en informatie over uzelf.
• Gebruikersinhoud.
◦ Uw berichten, Media in berichten en Oproepen: we bieden end-to-end versleuteling voor onze Diensten. End-to-end versleuteling betekent dat uw oproepen, berichten, media in berichten met inhoud zoals afbeeldingen, audio, video, documenten en bestanden, worden versleuteld om te voorkomen dat derden (waaronder DoWell) die inhoud zien. U kunt hier meer informatie vinden over end-to-end versleuteling en hoe bedrijven met u communiceren op DoWell.

Meestal worden uw berichten op uw apparaat bewaard en niet op onze servers. We slaan uw berichten tijdelijk in versleutelde vorm op terwijl ze worden afgeleverd. Zodra uw berichten zijn geleverd, worden ze van onze servers verwijderd.

Als een bericht niet kan worden geleverd, dan bewaren we dit bericht gedurende maximaal 30 dagen versleuteld op onze servers terwijl we het proberen te leveren. Als een bericht na 30 dagen nog steeds niet is geleverd, verwijderen we het. We kunnen de inhoud van niet-afgeleverde berichten die op onze servers zijn opgeslagen niet zien, omdat ze versleuteld zijn.

Wanneer een gebruiker media in een bericht stuurt, slaan we die media maximaal 30 dagen versleuteld op onze servers op om de levering efficiënter te maken, zoals wanneer ontvangers ervoor kiezen de media door te sturen. We kunnen de media niet zien omdat deze zijn versleuteld.
◦ Statusinformatie. U kunt ervoor kiezen om uw Status te delen, die ook end-to-end versleuteld is.
◦ Nauwkeurige locatiegegevens. We stellen u in staat uw Nauwkeurige locatiegegevens van uw apparaat te delen wanneer u ervoor kiest om locatiegerelateerde functies te gebruiken, zoals wanneer u besluit uw huidige locatie te delen met uw contacten of live locatie naar uw contacten te sturen of locaties in de buurt te bekijken. Nauwkeurige locatiegegevens die u deelt met uw contacten in uw chats zijn versleuteld, zodat DoWell deze niet kan zien. U kunt het delen van Nauwkeurige locatiegegevens beheren in uw in-app-instellingen (zie meer informatie voor iPhone en Android) en uw apparaatinstellingen.
◦ U kunt ook inhoud verstrekken die niet is versleuteld, wat betekent dat we deze kunnen zien. Dit omvat uw profielfoto, informatie over uzelf en namen en omschrijvingen van uw community’s en groepen. Wanneer u ervoor kiest om bepaalde functies van avatars te gebruiken, zoals het gebruik van een foto waarmee we een avatar kunnen voorstellen die beter op u lijkt, verwerken we de foto en delen van uw gezichts- en lichaamskenmerken in het fotokader. De informatie die we voor dit proces gebruiken, wordt niet gebruikt om u te identificeren.
• Uw connecties.
U kunt de functie voor het uploaden van contacten gebruiken en ons regelmatig de telefoonnummers in het adresboek van uw apparaat verstrekken, waaronder nummers van gebruikers van onze Diensten en van uw andere contacten. Als een van uw contacten nog geen gebruikmaakt van onze Diensten, beheren we deze informatie op een manier die is bedoeld om ervoor te zorgen dat deze contacten niet door ons kunnen worden geïdentificeerd. Meer informatie over het uploaden van contacten en over de gegevens die we verstrekken aan mensen die DoWell niet gebruiken vindt u hier. We verzamelen ook gegevens over gebruikers die contact met u opnemen en die niet in het adresboek van uw apparaat staan en over gebruikers die u hebt geblokkeerd of die u hebben geblokkeerd.
• Uw community- en groepsgegevens.
U kunt groepen en verzendlijsten maken, er lid van worden of worden toegevoegd aan community’s, groepen of verzendlijsten. Dergelijke community’s, groepen en lijsten worden gekoppeld aan uw account. U geeft uw groepen en community’s een naam. U kunt een profielfoto en/of een omschrijving van een community of groep verstrekken. We verzamelen ook gegevens over wanneer community’s en groepen worden gemaakt of bijgewerkt.
• Informatie over klantenservice en andere vormen van communicatie.
Wanneer u contact met ons opneemt voor klantenservice of anderszins met ons communiceert (bijvoorbeeld via optionele enquêtes), kunt u ons informatie verstrekken over uw gebruik van onze Diensten, waaronder kopieën van uw berichten en alle andere informatie die u nuttig vindt zodat wij uw vraag begrijpen en kunnen oplossen, en hoe wij met u contact kunnen opnemen (bijvoorbeeld een e-mailadres). U kunt ons bijvoorbeeld een e-mail sturen met informatie over het functioneren van onze app of andere kwesties. We verzamelen ook informatie over hoe u onze functies voor klantenservice gebruikt (zoals uw zoekopdrachten in ons Helpcentrum), feedback die u ons geeft over de klantenservice-ervaring en uw antwoorden op enquêtes of vragen over verschillende onderwerpen (waaronder bijvoorbeeld wat u wel of niet leuk vindt aan de Dienst of aan Aanbieders-bedrijven).
• Informatie over de toegang tot uw account.
Wanneer u zich registreert of aanmeldt bij onze Dienst, verifiëren we uw DoWell-account, bijvoorbeeld door u een code te sturen via sms of door u te bellen. U kunt ook een pincode toevoegen om verificatie in twee stappen in te schakelen en een e-mailadres dat kan worden gebruikt om die pincode te resetten. Afhankelijk van de omstandigheden vragen we u om informatie om te bewijzen dat u de echte eigenaar bent van uw DoWell-account.
Automatisch verzamelde informatie
• Gebruiksinformatie.
We verzamelen informatie over uw gebruik van onze Diensten. Dit omvat het verzamelen van gegevens over uw activiteiten (waaronder hoe u onze Diensten gebruikt), hoe u communiceert met anderen via onze Diensten (inclusief wanneer u een bedrijf zoekt en hiermee communiceert), en de tijd, frequentie en duur van uw activiteiten. Dit omvat ook gegevens over de functies die u gebruikt, zoals onze functies voor berichten (en geïntegreerde applicaties), bellen, Status, avatars, community’s of groepen, of zakelijke functies; of u online bent; tijdstempels met betrekking tot uw gebruik, zoals wanneer u onze Diensten voor het laatst hebt gebruikt (uw ‘laatst gezien’) en de keren dat u belt en wordt gebeld en berichten verzendt en ontvangt; en wanneer u voor het laatst uw Info-gegevens hebt bijgewerkt.
• Informatie over logbestanden en probleemoplossing.
We verzamelen gegevens over hoe onze Diensten presteren wanneer u deze gebruikt, zoals Dienstengerelateerde diagnostische en prestatiegegevens. Deze informatie omvat logbestanden, tijdstempels, diagnostische of crashgegevens, logboeken van websiteprestaties en foutberichten of rapporten.
• Apparaat- en verbindingsgegevens.
We verzamelen apparaat- en verbindingsspecifieke gegevens wanneer u onze Diensten installeert, bezoekt of gebruikt. Dit omvat gegevens zoals hardwaremodel, gegevens over het besturingssysteem, batterijniveau, signaalsterkte, appversie, browsergegevens, en informatie over het mobiele netwerk en de verbinding (waaronder of u wifi of mobiele data gebruikt, de mobiele provider of internetprovider), de taal en tijdzone, het IP-adres en informatie over de werking van het apparaat, evenals identifiers (waaronder identifiers die uniek zijn voor Producten van Aanbieders-bedrijven die zijn gekoppeld aan hetzelfde apparaat of hetzelfde account).
• Algemene locatiegegevens.
Zelfs als u er niet voor kiest gebruik te maken van onze nauwkeurige locatiegerelateerde functies (zie Gegevens die u en DoWell delen met derden), gebruiken we IP-adressen en andere informatie zoals netnummers om uw algemene locatie te schatten (zoals uw land).
• Cookies.
We verzamelen gegevens met behulp van cookies om onze webgebaseerde Diensten en website te exploiteren en aan te bieden. Meer informatie over hoe we cookies gebruiken om onze Diensten aan u aan te bieden.
• Gebruikerskeuzes.
We verzamelen informatie over uw in-app-instellingen en privacyinstellingen, en gegevens over wanneer u de voorwaarden hebt geaccepteerd. Alleen u hebt de controle over uw privacyinstellingen die bijvoorbeeld kunnen worden gebruikt om te wijzigen wie uw ‘laatst gezien’, profielfoto, info over uzelf, statusupdates, leesbewijzen kan zien of u aan groepen kan toevoegen. We verzamelen ook informatie over of u pushmeldingen hebt ingeschakeld en of u berichten met vervaldatum wilt verzenden.
• Verificatiegegevens.
Om de juiste autorisaties te verifiëren en te verlenen terwijl u de Diensten gebruikt (zoals wanneer u ervoor kiest om versleutelde back-ups te gebruiken en uw unieke wachtwoord te maken), maken en bewaren we verificatiecodes die een beveiligingsmaatregel zijn om ervoor te zorgen dat alleen u toegang hebt tot uw account. Verificatiegegevens omvatten ook uw openbare versleutelingscodes die door ons end-to-end-versleutelingsprotocol worden gebruikt. Berichten worden versleuteld voordat ze onze servers bereiken, wat betekent dat we ze niet kunnen zien.
Gegevens die derden over u verstrekken
• Gegevens die anderen over u verstrekken.
We ontvangen gegevens over u van andere gebruikers. Wanneer andere gebruikers die u kent bijvoorbeeld onze Diensten gebruiken, kunnen zij uw telefoonnummer opgeven als ze de functie voor het uploaden van contacten gebruiken, net zoals u hun telefoonnummer kunt verstrekken. We vereisen dat al deze gebruikers uw gegevens rechtmatig verzamelen, gebruiken en delen voordat zij ons gegevens verstrekken. Ze kunnen u ook een bericht sturen, berichten sturen aan groepen waarvan u lid bent of u bellen. Houd er rekening mee dat in het algemeen iedere gebruiker screenshots van uw chats of berichten kan vastleggen of opnamen van uw gesprekken met hen kan maken en deze naar DoWell of iemand anders kan versturen, of ze op een ander platform kan plaatsen.
• Gebruikersrapporten.
Net zoals u andere gebruikers kunt rapporteren, kunnen andere gebruikers of derden er ook voor kiezen om uw interacties en uw berichten met hen of anderen via onze Diensten aan ons te rapporteren; bijvoorbeeld om mogelijke schendingen van onze Voorwaarden of ons beleid te melden. Wanneer een rapport bij ons wordt ingediend via de rapportagetools, ontvangen we informatie van de melder over zowel de rapporterende gebruiker als de gerapporteerde gebruikers. • Bedrijven op DoWell.
Wanneer bedrijven waarmee u communiceert tijdens het gebruik van onze Diensten ons informatie verstrekken over hun interacties met u, eisen we van elk van deze bedrijven dat ze handelen in overeenstemming met de toepasselijke wetgeving.

Wanneer u via DoWell een bericht naar een bedrijf stuurt, moet u er rekening mee houden dat de inhoud die u deelt zichtbaar kan zijn voor meerdere mensen in dat bedrijf. Bovendien werken sommige bedrijven mogelijk samen met externe dienstverleners (waaronder Aanbieders) om hun communicatie met hun klanten te helpen beheren. Een bedrijf kan bijvoorbeeld dergelijke externe dienstverleners toegang geven tot hun communicatie om deze voor het bedrijf te verzenden, op te slaan, te lezen, te beheren of anderszins te verwerken. Om te begrijpen hoe een bedrijf uw gegevens verwerkt, waaronder hoe het uw gegevens kan delen met derden of Aanbieders, moet u het privacybeleid van dat bedrijf doornemen of rechtstreeks contact opnemen met dat bedrijf.
• Diensten van derden.
DoWell ontvangt informatie over kwaadwillenden en misbruik van Aanbieders-bedrijven en appverificatiegegevens van antimisbruikdiensten ter bevordering van de veiligheid, beveiliging en integriteit. Wanneer Aanbieders zich bijvoorbeeld bewust wordt van oplichting waarbij individuen worden aangemoedigd om contact op te nemen met een telefoonnummer via DoWell, kunnen ze dat telefoonnummer delen met DoWell, zodat we het DoWell-account kunnen onderzoeken.

We stellen u ook in staat onze Diensten te gebruiken in samenhang met Diensten van derden en Producten van Aanbieders-bedrijven. Als u onze Diensten gebruikt met dergelijke diensten van derden of Producten van Aanbieders-bedrijven, dan kunnen wij informatie over u van hen ontvangen, bijvoorbeeld als u de knop Delen van DoWell gebruikt op een nieuwsdienst om een nieuwsbericht te delen met uw DoWell-contacten, -groepen of verzendlijsten via onze Diensten. We wijzen u erop dat wanneer u gebruikmaakt van diensten van derden of Producten van Aanbieders-bedrijven, de voorwaarden en het privacybeleid van het bedrijf dat die diensten aanbiedt van toepassing zullen zijn op uw gebruik van die diensten en producten.

Gegevens die u en DoWell delen met derden

U deelt gegevens wanneer u onze Diensten gebruikt en via deze Diensten communiceert, en wij delen uw gegevens om ons te helpen onze Diensten te exploiteren, aan te bieden, te verbeteren, er inzicht in te krijgen, aan te passen en te ondersteunen.

• Verzenden van uw gegevens naar degenen met wie u wilt communiceren. U deelt Gebruikersinhoud wanneer u via onze Diensten communiceert. U hebt de controle over wat u verzendt wanneer u uw gegevens verzendt naar de particuliere of zakelijke DoWell-gebruikers met wie u wilt communiceren. Houd er rekening mee dat, zodra u Gebruikersinhoud naar een DoWell-gebruiker hebt verzonden, deze gebruiker de inhoud kan opslaan of opnieuw kan delen met anderen in onze Diensten en daarbuiten.
• Informatie die is gekoppeld aan uw account. Als onderdeel van uw DoWell-berichtenervaring en op basis van uw privacyinstellingen, kunnen de gebruikers die uw telefoonnummer hebben uw accountgegevens zien (telefoonnummer, profielfoto, informatie over uzelf) en u toevoegen aan groepen en community’s waar deze gegevens vervolgens mogelijk zichtbaar zijn voor anderen in de groep of community. Wanneer u een bericht naar een andere gebruiker of een groep verzendt, wordt de door u gekozen profielnaam zichtbaar voor de ontvangers van het bericht, inclusief gebruikers die u niet in hun contactenlijst hebben staan. Gebruikers die uw telefoonnummer hebben, kunnen ook uw ‘laatst gezien’-informatie en uw leesbewijzen zien, afhankelijk van uw privacyinstellingen. U kunt uw privacyinstellingen configureren om groepslidmaatschap te beheren, evenals bepaalde informatie (bijvoorbeeld uw ‘laatst gezien’) die beschikbaar is voor andere gebruikers. • Diensten van derden. Wanneer u, of andere gebruikers met wie u communiceert, diensten van derden of andere Producten van Aanbieders-bedrijven gebruiken die zijn gekoppeld via onze Diensten, kunnen de aanbieders van die diensten of producten de informatie over u ontvangen die u of anderen met hen delen. Als u bijvoorbeeld een gegevensback-updienst gebruikt die is geïntegreerd in onze Diensten (zoals iCloud of Google Drive), ontvangt deze gegevensback-updienst de informatie die u met de dienst deelt, zoals uw DoWell-berichten, en als u vanuit DoWell op internet zoekt naar een groepsprofielfoto, ontvangt de aanbieder van de zoekmachine de zoekterm die u gebruikt.
